Terms of Use

These Terms of Use ("Terms") govern your use of the Cirka app ("the app", "Service") published by ArLinz ("we", "us", "our"). By installing or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. The App in Plain Language

Cirka generates wellness plans intended to help travellers manage jet lag and travel fatigue. It is not a medical device, not a diagnostic tool, and not a substitute for professional medical advice.

2. Eligibility

You must be at least 17 years old to use the app. By using the app, you represent that you are at least 17. If you are using the app on behalf of a minor in your care, you accept these Terms on their behalf and assume responsibility for their use.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices you own or control, in accordance with the Apple Media Services Terms and Conditions and these Terms.

You may not: - Reverse engineer, decompile, or attempt to extract source code from the app. - Resell, sublicense, lease, or commercially redistribute the app. - Use the app to violate any applicable law, regulation, or third-party right. - Modify or create derivative works of the app, except as expressly permitted by Apple's standard end-user license.

4. Pricing

Cirka is currently free and contains no in-app purchases or subscriptions. We may add paid features in future versions; if so, those Terms will be updated and you will be notified before any charge applies.

5. Wellness and Medical Disclaimer (Important)

Cirka is a wellness planning tool, not a medical device. The app does not diagnose, treat, cure, or prevent any disease or condition. Plan items generated by the app — including but not limited to:

You should: - Consult a qualified healthcare provider before starting, stopping, or changing any medication, supplement, fasting protocol, or significant change to your sleep or eating schedule. - Not use the app to manage clinical sleep disorders (insomnia, sleep apnea, narcolepsy, circadian rhythm disorders) or any condition that requires medical care. - Not use the app's weight-loss program if you have a history of eating disorders, are pregnant or breastfeeding, are diabetic, take medications affected by fasting, or have any condition where dietary restriction may be harmful. Consult your physician. - Not use the melatonin guidance if you are pregnant, breastfeeding, taking interacting medications (anticoagulants, immunosuppressants, sedatives, certain antidepressants), have an autoimmune condition, or have been advised against melatonin use. - Discontinue use and seek medical attention if you experience adverse effects.

By using the app, you acknowledge that you understand these limitations and accept full responsibility for any decisions you make based on the app's suggestions.

All content, logos, designs, code, and circadian-science methodology embodied in the app are owned by ArLinz or our licensors. You acknowledge that the app contains proprietary information protected by copyright and other intellectual property laws.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: - The app will be uninterrupted, timely, secure, or error-free. - Plan suggestions will produce any specific health, sleep, weight, or jet-lag outcome. - Notifications will fire at exactly the scheduled time (timing depends on your device, iOS, Do Not Disturb, Focus modes, and battery state). - HealthKit data shown in the app will be complete or accurate (it depends on the source — Apple Watch, third-party apps, manual entry).

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARLINZ AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO MISSED FLIGHTS, MISSED MEETINGS, ADVERSE HEALTH OUTCOMES, LOST DATA, OR LOST PROFITS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD 50, WHICHEVER IS GREATER.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless ArLinz, its officers, employees, and contractors from any claim, demand, or damage arising out of your misuse of the app, your violation of these Terms, or your violation of any third-party right, including any health-related decision you make based on app suggestions without consulting a healthcare provider.

12. Termination

We may suspend or terminate your access to the app at any time for violation of these Terms. You may stop using the app at any time by deleting it from your device. To remove all locally stored data, delete the app entirely.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be communicated via app update notes or the support page. Continued use of the app after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the courts of Singapore, except where local consumer-protection law gives you a non-waivable right to bring claims in your country of residence.

If you are an EU/UK consumer, this clause does not affect your statutory rights.
